Terms of Service

These terms govern the site and the general principles. They do not replace the individual contract provided to the client before payment.

1. Identity of the provider

Services are offered by Kevin Racine, doing business as KR Kinetics. NEQ: 2282392176.

Applicable taxes, if any, will be clearly indicated before payment.

The business address and phone number are not publicly displayed. They are communicated in the individual contract before any payment, or upon a justified written request.

Before any payment, the written individual contract contains the mandatory complete contact information (name, address, phone, email), as well as the price, inclusions, and cancellation terms.

2. Initial consultation

The initial consultation is free and comes with no obligation. It is used to understand your goals, verify whether the requested service falls within KR Kinetics' competence, and clearly present the price, inclusions, timelines, and terms. KR Kinetics may decline or discontinue a service when it is not appropriate, safe, or compatible with its competence.

3. Services

KR Kinetics offers a one-time custom training program, a one-time personalized nutrition framework, and a monthly Complete Coaching service. The exact features, deliverables, delivery timeline, total price, applicable taxes if any, payment terms, included adjustments, and cancellation terms are specified in the individual contract.

4. Formation of the contract

No paid contract is formed by simply booking a consultation. Before payment, the client receives a written proposal allowing them to verify and correct their information, and to accept or decline the service. A durable copy of the accepted contract is sent to them by email.

5. Payment

Payment is due according to the individual contract. No payment is required at the time of the free booking. Amounts are in Canadian dollars. The payment methods used are Stripe and Interac e-Transfer. KR Kinetics does not add undisclosed fees.

6. One-time services

For a one-time service, design begins after the contract is accepted, the necessary information is received, and the agreed payment is made. The contract specifies the delivery timeline and the review period. Adjustments that are not included may require a separate service agreement and a separate price.

7. Monthly Complete Coaching

Complete Coaching is a monthly service of indefinite duration, with no minimum commitment, renewed for successive monthly periods until cancellation. The contract specifies the renewal date, the monthly amount, and the payment method. The client may cancel by email to kev.racine@krkinetics.com, or according to the mechanism indicated in their individual contract, before the next renewal. Cancellation is confirmed in writing and the service remains active until the end of the period already paid for, unless otherwise agreed or required by law.

As part of complete coaching, the training program is prepared and delivered one week at a time. The following week is generally created every Sunday based on the results and feedback provided during the previous week.

If coaching is cancelled, the service remains active until the end of the period already paid. No programming covering a later period is owed or delivered in advance.

Messages related to coaching are usually answered within one business day, often sooner. Communication is not an emergency service and does not imply continuous availability.

8. Cancellation and refund

The terms of cancellation, rescission, termination, and refund are indicated before purchase and in the individual contract. Nothing in these terms limits the mandatory consumer rights provided under the Consumer Protection Act or any other applicable law.

9. Client responsibilities

The client must provide accurate and up-to-date information, promptly inform KR Kinetics of any pain, injury, limitation, pregnancy, medical condition, relevant medication, or change that may affect safety, follow the instructions given, and stop the activity when an unusual symptom occurs.

The client remains responsible for obtaining appropriate care or evaluations. KR Kinetics may, however, recommend or require a professional consultation and suspend a recommendation when the situation exceeds its competence or presents a risk.

10. Limits of the service

KR Kinetics is not a medical service and does not make any diagnosis, prescribe any treatment, practice any physiotherapy, or treat any disease. Nutrition services are aimed at the general organization of habits and intake in a non-clinical context. A medical situation or an intervention aimed at preventing, correcting, or treating a disease is referred to a physician, a registered dietitian-nutritionist, or another qualified professional.

11. Suspension for safety reasons

KR Kinetics may suspend an activity, decline an exercise, request medical clearance, or end the service when it reasonably believes that continuing presents a risk or exceeds its competence. A client's refusal to follow a recommendation to consult a professional may make it impossible to continue coaching.

12. Risks and results

Physical activity carries inherent risks and results vary from person to person. KR Kinetics is committed to acting prudently within the limits of its competence, but does not guarantee any specific result. The client is encouraged to progress gradually and to report any issue.

14. Intellectual property

The programs, charts, documents, and content provided are for the client's personal use. They may not be resold, published, reproduced, or distributed to third parties without written authorization. The client may keep a copy for personal use.

Unless otherwise indicated, the texts, photographs, illustrations, logos, graphic elements, layouts, tables, templates, and other original content of the site and deliverables are protected by applicable laws. They may not be reproduced, adapted, published, distributed, substantially extracted, or commercially exploited without written authorization, except to the extent permitted by law. This protection does not extend to general ideas, methods, or facts that are not protectable by law.

The KR Kinetics name and logo may not be used in a way that suggests authorization, affiliation, or endorsement without written consent.

15. Communications

The client chooses among the communication methods offered (email, SMS, Messenger) and understands that they do not all offer the same level of confidentiality.

These communication methods, as well as the site's form, must never be used for a medical emergency. In an urgent situation, contact 911 or local emergency services.

16. Protection of information

The collection and management of personal information are governed by the Privacy Policy and by the separate consent applicable to sensitive information.

17. Governing law and complaints

These terms are governed by the laws applicable in Quebec and Canada, without depriving the consumer of the mandatory protections of their place of residence. A question or complaint may be sent to kev.racine@krkinetics.com.

18. Amendment

Published changes apply to new uses and new contracts. A significant change to an ongoing contract requires the client's agreement when required by law or by the contract.
